This Marketplace Policy outlines the rules, standards, prohibited products, and acceptable conduct applicable to all users and vendors of the Shop Mart marketplace.
Shop Mart is committed to maintaining a safe, trustworthy, and legally compliant marketplace for customers, vendors, and the wider Saint Lucian business community.
All Vendors and Users are required to comply with this policy as a condition of using the Shop Mart platform.
1. Purpose
Shop Mart is committed to providing a safe, trustworthy, and legally compliant marketplace for customers and Vendors.
This policy helps protect customers, Vendors, Shop Mart, and the wider community from fraud, illegal activity, intellectual property violations, and unsafe products.
2. Vendor Responsibilities
Vendors are solely responsible for:
- Ensuring products comply with all applicable laws and regulations.
- Maintaining accurate product information.
- Ensuring products are safe for their intended use.
- Obtaining any licenses, permits, or approvals required to sell their products.
- Complying with intellectual property laws.
Vendors must immediately remove or correct listings that violate this policy.
3. Prohibited Products
The following products are prohibited from being listed, advertised, sold, or distributed through Shop Mart:
Illegal Products
- Products prohibited by the laws of Saint Lucia.
- Products requiring licenses or permits not possessed by the Vendor.
- Products obtained unlawfully.
- Stolen goods.
Counterfeit and Infringing Goods
- Counterfeit products.
- Unauthorized replicas.
- Products infringing trademarks, copyrights, patents, or intellectual property rights.
- Pirated software, media, or digital content.
Weapons and Dangerous Items
- Firearms.
- Ammunition.
- Explosives.
- Fireworks prohibited by law.
- Weapons prohibited by law.
- Hazardous materials prohibited for public sale.
Illegal Drugs and Controlled Substances
- Narcotics.
- Controlled substances.
- Drug paraphernalia prohibited by law.
- Products intended to facilitate illegal drug use.
Fraudulent Products
- Products making false claims.
- Products intended to deceive consumers.
- Products falsely claiming certification or approval.
- Products misrepresenting their origin or authenticity.
Recalled or Unsafe Products
- Products subject to government recalls.
- Products known to be unsafe.
- Products presenting unreasonable health or safety risks.
4. Restricted Products
Certain product categories may require prior approval, verification, licenses, permits, or additional documentation before listing.
These categories may include:
- Health products.
- Medical devices.
- Food and beverage products.
- Dietary supplements.
- Agricultural products.
- Cosmetics.
- Products regulated by governmental authorities.
Shop Mart reserves the right to require documentation or refuse listings within these categories.
5. Made in Saint Lucia Category
Products listed under the 🇱🇨 Made in Saint Lucia category must meet the requirements established by Shop Mart.
Products must:
- Be manufactured in Saint Lucia; or
- Be grown in Saint Lucia; or
- Be handcrafted in Saint Lucia; or
- Be substantially transformed within Saint Lucia.
Misrepresentation of a product’s origin may result in listing removal, account suspension, or account termination.
6. Prohibited Vendor Conduct
Vendors may not:
- Provide false or misleading information.
- Engage in fraudulent activities.
- Manipulate reviews, ratings, or marketplace metrics.
- Create duplicate accounts to circumvent restrictions.
- Misrepresent products or services.
- Use offensive, abusive, or unlawful content.
- Attempt to bypass Shop Mart systems or security controls.
- Solicit customers to complete sales outside the platform for the purpose of avoiding marketplace fees.
7. Prohibited Customer Conduct
Customers may not:
- Submit fraudulent order claims.
- Abuse refund processes.
- Submit false chargebacks.
- Use the platform for unlawful purposes.
- Harass Vendors or other users.
- Attempt unauthorized access to accounts or systems.
8. Content Standards
Users may not upload, publish, or transmit content that:
- Is unlawful.
- Contains misleading information.
- Infringes intellectual property rights.
- Contains malicious code or software.
- Violates privacy rights.
- Encourages illegal activity.
- Damages the reputation of Shop Mart or other users through knowingly false information.
9. Intellectual Property Rights
Vendors must have all necessary rights, permissions, and licenses required to use product images, logos, trademarks, branding, and other content published on the platform.
Shop Mart reserves the right to remove content that may infringe intellectual property rights and may suspend accounts associated with repeated violations.
10. Enforcement Actions
Shop Mart may take any action deemed necessary to protect the marketplace, including:
- Removing listings.
- Restricting account privileges.
- Suspending accounts.
- Terminating accounts.
- Withholding payouts pending investigation.
- Reporting unlawful activity to appropriate authorities.
Shop Mart reserves the right to take action without prior notice where necessary to protect customers, Vendors, or the platform.
11. Platform Discretion
Shop Mart reserves the right, in its sole discretion, to determine whether any product, service, listing, activity, or content violates this policy.
Shop Mart’s decisions regarding marketplace compliance and enforcement shall be final.
12. Limitation of Liability
Shop Mart provides a technology platform connecting customers and independent Vendors.
Shop Mart does not inspect, verify, test, warrant, endorse, or guarantee every product listed by Vendors.
Responsibility for products and services remains solely with the Vendor offering them.
13. Changes to this Marketplace Policy
Shop Mart may modify this Marketplace Policy at any time.
Updated versions will be posted on this page together with an updated effective date.
