3. Marketplace Disclaimer

Shop Mart operates solely as an online marketplace platform.

Shop Mart connects customers with independent Vendors who offer products and services for sale through the platform.

Unless expressly stated otherwise:

Shop Mart is not the seller of products.
Shop Mart does not manufacture products.
Shop Mart does not own inventory.
Shop Mart does not warehouse products.
Shop Mart does not fulfill orders.
Shop Mart does not provide delivery services.

Products and services available on Shop Mart are offered and sold by independent Vendors.

The purchase of products or services through Shop Mart constitutes a transaction directly between the customer and the Vendor.

4. Eligibility

By using Shop Mart, you represent and warrant that:

You are at least eighteen (18) years old; or
You are using the platform under the supervision of a parent or legal guardian.

You agree to provide accurate and complete information when creating an account.

5. User Accounts

Users may be required to create an account to access certain features.

Users are responsible for:

Product quality.
Product accuracy.
Product availability.
Vendor performance.

7. Orders

When a customer places an order:

The order request is transmitted to the Vendor.
Vendors are responsible for fulfilling accepted orders.
Vendors may reject or cancel orders under certain circumstances.

Shop Mart reserves the right to cancel or refuse transactions where necessary to protect customers, Vendors, or the marketplace.

8. Payments

Shop Mart supports payment methods that may include:

Stripe
Penny Pinch
Fygaro
Bank Wire Transfer

Payment processing may be performed by independent third-party payment providers.

Shop Mart does not store complete payment card information on its servers.

9. Platform Service Fee

A Platform Service Fee may be charged on certain orders.

This fee helps support:

Marketplace operations
Customer support
Platform security
Order tracking systems
Technology development and maintenance

Applicable fees will be disclosed during checkout where required.

10. Shipping & Delivery

Delivery responsibilities belong to the Vendor unless expressly stated otherwise.

Vendors may:

Use their own personnel.
Use independent couriers.
Use third-party delivery services.

Delivery schedules are estimates only.

Shop Mart does not guarantee delivery dates or delivery times.

11. Returns & Refunds

Eligible products may generally qualify for refund requests within seven (7) calendar days after an order has been marked as completed.

13. Vendor Participation

Vendors using Shop Mart must comply with:

Applicable laws and regulations

Shop Mart reserves the right to:

Approve or reject vendors
Suspend vendor accounts
Remove product listings
Terminate marketplace participation

where necessary to protect the platform or its users.

14. Intellectual Property

All Shop Mart branding, logos, designs, website content, software, graphics, and related materials are owned by or licensed to Shop Mart Ltd.

Users may not:

Copy
Reproduce
Modify
Republish
Redistribute

Shop Mart content without prior written authorization.

Vendors retain ownership of their own content, trademarks, and intellectual property.

15. User Conduct

Users may not:

Violate any applicable laws.
Submit false information.
Commit fraud.
Circumvent marketplace fees.
Interfere with platform operations.
Upload malicious software.
Infringe intellectual property rights.
Abuse customers, vendors, or staff.

Violations may result in account suspension or termination.

16. Platform Availability

Shop Mart strives to maintain reliable service but does not guarantee uninterrupted access to the platform.

The marketplace may occasionally experience:

Maintenance periods
Technical failures
Internet disruptions
Service interruptions
Payment provider outages
Events beyond our control

Access to the platform may be interrupted without notice.

17. Third-Party Services

Shop Mart relies on various third-party providers, including:

20. Force Majeure

Shop Mart shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including:

Earthquakes
Fires
Pandemics
Government actions
Internet outages
Power failures
Labor disputes
Transportation disruptions
Other force majeure events

21. Account Suspension and Termination

for violations of these Terms, marketplace policies, or applicable laws.

23. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Saint Lucia.

Any disputes arising from the use of Shop Mart shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.
